COVID-19 related workers compensation cases

In September 2020, the governor signed SB 2380 creating a rebuttable presumption of Workers’ Compensation coverage for COVID-19 cases contracted by essential employees. This legislation is effective retroactively to March 9, 2020.

An essential employee can be a public or private sector employee who:

  • Is a public safety worker or first responder (police, fire or other);
  • Is involved in providing medical or other healthcare facilities, residential facilities or homes;
  • Performs functions that involve physical proximity to members of the public and are essential to the public health, safety and welfare, including transportation services, financial services, production, preparation, storage, sale, distribution of essential goods such as food, beverage, medicine, fuel and supplies;
  • Is any other employee deemed an essential employee by the public authority declaring the state of emergency (a catchall).

  • Grocery/food store employees
  • Pharmacy
  • Medical supply store
  • Retail sections of gas stations
  • Convenience store
  • Cashiers/clerks
  • Construction workers

Under the new law, if an individual contracts COVID-19 during the time that an individual is working as an essential employee other than in the individual’s own residence, there shall be a rebuttable presumption that the contraction of disease is work-related and fully compensable for the purpose of WC benefits.

This presumption significantly lessens an employee’s burden of proving that COVID-19 related illness is compensable under our WC laws.

Per CDC (subject to updating):

These illnesses can linger in anyone regardless of age or health, even if your period of COVID illness was mild or if you had no initial symptoms.

  • Difficulty breathing or shortness of breath
  • Tiredness or fatigue
  • Symptoms that can get worse after physical or mental activities
  • Difficulty thinking or concentrating (brain fog)
  • Cough
  • Chest or stomach pain
  • Headache
  • Fast breathing or pounding heart
  • Joint or muscle pain
  • Pins and needles feeling
  • Diarrhea
  • Sleep problems
  • Fever
  • Dizziness on standing
  • Rash
  • Mood changes
  • Change in smell or taste
  • Change in period cycles
  • Pulmonary markers (lung function restrictions)
  • Myocarditis (inflammation around the heart)
  • Pericarditis (inflammation of percaridium)
  • Diminished kidney function

  • Multisystem inflammatory syndrome

  • Depression or anxiety

Imaging tests have shown lasting damage to heart muscle which may increase the risk of heart failure or other heart complications. The pneumonia associated with COVID-19 can cause long standing damage to the tiny air sacs (alveoli) in the lungs. The resulting scar tissue can lead to long-term breathing problems.

Even in young people, COVID-19 can cause strokes, seizures and Guillain-Barre syndrome – a condition that causes temporary paralysis. COVID-19 may also increase the risk of developing Parkinson’s disease and Alzheimer’s disease.

COVID-19 can make blood cells more likely to clump up and form clots. Much of the heart damage stems from very small clots that block tiny blood vessels (capillaries) in the heart muscle. Lungs, legs, liver and kidneys may also be affected by these blood clots. COVID-19 can weaken the blood vessels causing them to leak.
