Personal Injury & Workers Compensation

Personal Injury accidents are often devastating to the person injured and his or her family members. Victims may be left with life-threatening or debilitating injuries that result in permanent disability. If you or a loved one has been injured, you may have a right to take legal action against the parties responsible for your losses.

At Rothstein, Mandell, Strohm, Halm & Cipriani, we are committed to protecting the rights of those injured in accidents. We recognize the sheer devastation accidents can have on an individual’s life. You may be entitled to be compensated for pain, suffering and disability – past, present and future! You are entitled to lost wages and future lost earning capacity.

Personal injury and workers compensation

Determining both cause and liability

Our firm has extensive experience and will conduct a comprehensive investigation to identify all issues including liability, damages and all coverage sources.

If necessary, we will seek the assistance of accident reconstruction experts, vocational experts, economists and other specialists when building your case. No matter the situation, we are committed to helping you and your family recover the maximum compensation to which you are entitled.

Workers' Compensation

When you enter your place of employment each day, you expect to spend your time working in a relatively safe environment. In reality, many workplaces have hidden dangers that can lead to serious job-related injuries. If you or a loved one has been injured at work, be certain your right to compensation under the New Jersey Workers’ Compensation Act is fully protected.

At Rothstein, Mandell, Strohm, Halm & Cipriani, led by board-certified specialist Charles Mandell, and Brian Bartlett, we provide dedicated representation in the area of workers’ compensation. Our primary objective is always to help our clients recover the medical care, wage reimbursement benefits and permanent disability awards to which they are entitled. We offer a free consultation to evaluate your on-the-job injury, answer your questions and explain your legal options.

Give us a call today to arrange a confidential consultation with an experienced workers’ compensation lawyer at our firm. With 90 years of experience between Mr. Mandell and Mr. Bartlett, we serve clients throughout New Jersey.

Are you eligible for workers' compensation?

Contrary to popular belief, not every workers’ compensation claim is the result of falling objects, dangerous equipment, slip and falls, or other workplace accidents. Many people are stricken by work-related illnesses or ailments that develop over time such as carpal tunnel syndrome and repetitive stress injuries. Many disabilities can be materially attributed to the work effort over time. These occupational claims may also be compensable.

Whether you have experienced an acute injury or are dealing with a prolonged illness or condition, call us and we will advise you of the appropriate course of action.

Put Your Case In Capable Hands

Your employer or its workers’ compensation insurance company may attempt to deny the benefits you deserve or force you into returning to work before you are fully healed. At Rothstein, Mandell, Strohm, Halm & Cipriani, we find this sort of treatment unacceptable.

Our legal team will strive to resolve your case, amicably, whenever possible. In the event negotiations break down, we are prepared to fight for your benefits in court.

COVID-19 related workers compensation cases

In September 2020, the governor signed SB 2380 creating a rebuttable presumption of Workers’ Compensation coverage for COVID-19 cases contracted by essential employees. This legislation is effective retroactively to March 9, 2020.

An essential employee can be a public or private sector employee who:

  • Is a public safety worker or first responder (police, fire or other);
  • Is involved in providing medical or other healthcare facilities, residential facilities or homes;
  • Performs functions that involve physical proximity to members of the public and are essential to the public health, safety and welfare, including transportation services, financial services, production, preparation, storage, sale, distribution of essential goods such as food, beverage, medicine, fuel and supplies;
  • Is any other employee deemed an essential employee by the public authority declaring the state of emergency (a catchall).

  • Grocery/food store employees
  • Pharmacy
  • Medical supply store
  • Retail sections of gas stations
  • Convenience store
  • Cashiers/clerks
  • Construction workers

Under the new law, if an individual contracts COVID-19 during the time that an individual is working as an essential employee other than in the individual’s own residence, there shall be a rebuttable presumption that the contraction of disease is work-related and fully compensable for the purpose of WC benefits.

This presumption significantly lessens an employee’s burden of proving that COVID-19 related illness is compensable under our WC laws.

Per CDC (subject to updating):

These illnesses can linger in anyone regardless of age or health, even if your period of COVID illness was mild or if you had no initial symptoms.

  • Difficulty breathing or shortness of breath
  • Tiredness or fatigue
  • Symptoms that can get worse after physical or mental activities
  • Difficulty thinking or concentrating (brain fog)
  • Cough
  • Chest or stomach pain
  • Headache
  • Fast breathing or pounding heart
  • Joint or muscle pain
  • Pins and needles feeling
  • Diarrhea
  • Sleep problems
  • Fever
  • Dizziness on standing
  • Rash
  • Mood changes
  • Change in smell or taste
  • Change in period cycles
  • Pulmonary markers (lung function restrictions)
  • Myocarditis (inflammation around the heart)
  • Pericarditis (inflammation of percaridium)
  • Diminished kidney function
  • Diminished brain function
  • Skin changes
  • Multisystem inflammatory syndrome
  • Severe weakness
  • Exhaustion
  • Depression or anxiety

Imaging tests have shown lasting damage to heart muscle which may increase the risk of heart failure or other heart complications. The pneumonia associated with COVID-19 can cause long standing damage to the tiny air sacs (alveoli) in the lungs. The resulting scar tissue can lead to long-term breathing problems.

Even in young people, COVID-19 can cause strokes, seizures and Guillain-Barre syndrome – a condition that causes temporary paralysis. COVID-19 may also increase the risk of developing Parkinson’s disease and Alzheimer’s disease.

COVID-19 can make blood cells more likely to clump up and form clots. Much of the heart damage stems from very small clots that block tiny blood vessels (capillaries) in the heart muscle. Lungs, legs, liver and kidneys may also be affected by these blood clots. COVID-19 can weaken the blood vessels causing them to leak.

Personal Injury/Car Accident

New Jersey’s no-fault auto insurance contains many pitfalls for the inexperienced. For example, if you do not follow the required procedures when obtaining medical care following an accident, you could be responsible for your own medical bills, even if the accident was not your fault.

The lawyers at Rothstein, Mandell, Strohm, Halm & Cipriani, offer a free initial consultation to explain your coverage and your rights. We have decades of experience in defending the rights of clients in serious injury cases.

Did You Know?

  • You may be entitled to no-fault insurance benefits even if the accident was your fault.
  • Your auto insurance company should pay for your medical benefits unless you selected your private health insurance to be your primary insurer in car accident cases or a valid exemption applies.
  • Your ability to sue the at-fault driver may be limited, depending on the insurance coverage you selected. We will discuss your rights with you.
  • Some no-fault insurance plans provide payments for lost wages.
  • The amount of the deductible depends on your insurance plan.

Wrongful Death

Losing a loved one is devastating, but often those feelings are compounded when the death is a result of someone else’s negligence or recklessness, and especially when the tragedy could have been prevented.

Wrongful death cases are often complex and involve collecting a great deal of valuable evidence that will be used to build a strong case for settlement negotiations or for trial. Therefore, it is crucial to contact a skilled attorney as soon after the accident as possible, so you understand your rights and how to collect and preserve this evidence.

Mr. Bartlett has over 40 years’ experience successfully resolving these matters. If you have lost a loved one to an accident and believe you have a wrongful death claim, please call Rothstein, Mandell, Strohm, Halm & Cipriani for a free case evaluation today.

What is the real value of your loss?

While we understand you cannot put a price on the loss of a loved one from a fatal accident, there are legal remedies available to make the person who is responsible pay for his or her negligent or intentional behavior. We will work with your insurance companies to make sure all claims are paid in full and in a timely manner. We will also seek to recover compensation for your loss of income, loss of consortium and loss of companionship in our suit against the at-fault party.

We will seek to recover punitive damages, which is money the responsible party must pay as a form of punishment for causing this tragedy. This proof comes because of our thorough investigation and commitment to building a solid and detailed case, which proves responsibility and a necessity for this monetary compensation to help you move forward in life financially.

If there is evidence of conscious pain and suffering, prior to death, the decedent’s estate may be entitled to significant compensation. Our lawyers have a long track record of experience handling wrongful death or survivorship claims resulting from motorcycle, truck or car accidents as well as fatal accidents that occur on construction sites. We will answer all your questions, give our honest opinion and present you with the best options for your specific situation.
